
Hello, We are planning as Wikipedians in Kenya to take photos of monuments and buildings around Nairobi then later upload them to Wikimedia Commons under the Creative Commons license. These photos are in turn used in Wikipedia articles lacking pictures or Articles shall later be written that were lacking yet the photograph is now available. On that note, am I required to have some form of permit? Or any other form of permission from the Kenyan authorities. Great idea !! I have been looking for CC photos of Nairobi yesterday on Wikimedia... Thanks Gichingiri for your reply. I guess you are right, although we may think that public/govt properties fall into public domain and can be shot without prior permission (unless there is a sign saying "no picture"); but last events showed that you can not take picture of public places without consent of City Council and especially now with that Al-Shabaad threat ! Law varies a lot from country to country, but note that in general, private properties/buildings fall into copyright protection and thus private properties/buildings can be photographed without consent of owners; same remarks for buildings/properties decorated for specific events, then you must have consent of owners as well as person in charge of decoration/event organizers (do you remember the Effeil Tower story, you can picture the Effeil Tower during the day as it falls into the public domain; but at night, you can't !! It's worth getting in touch with local authorities and law enforcement either way. I had a horrible experience in Pointe Noire, Congo last December. I also saw some tourists getting harassed when they took pics of the Dedan Kimathi statue the other day - which I though was totally uncalled for. It doesn't help that some buildings that are landmarks e.g. KICC may or may not be classified as restricted, depending on who's arresting you. It gets worse. It was a big deal for me once at Kinshasa airport, when they were searching through my laptop bag, and my camera was inside it. Some idiot cops/customs guys harassed me, saying I needed a permit. So I told them to show me where to apply and pay, and reminded them I'd need two more permits for my phones too, since they both have cameras. And I proceeded to ask other travellers if they had permits for their phones too.....I pissed them off so much they had to let me go. Hello, We are a group of volunteers under the umbrella of Wikimedia foundation which is non-profit. We will be having no tripods just simple DSLRs like the Nikon D5000, smartphone cameras and so on. Someone charging me for 4K+10K per street is totally insane. So to say. If anything we will be doing a great task of putting Kenya's capital on the web. These images shall later be uploaded to WikiCommons under the CC license which implies they are free for reuse either commercially or freely. Anyhu, I will make a point of going to Central police station because of the current invasion by KDF into Somalia. Plus the CCN who am sure will charge some amount. Hello, I actually visited the City council and they advised me that I needed a letter from the Ministry of information! They usually charge 2600KES per day for taking pictures of buildings and monuments. I was wondering why they should have such bureaucratic processes while for my case am doing this on a voluntary capacity for a non-commercial endeavor under the umbrella of the Wikimedia Foundation. This is utter rubbish. I have traveled through many cities in the west and I have never found one that you have to pay to take photos with a hand held. In some places I have even asked cops to pose in the shot and they do it so gladly. Stephen and Mblayo, Why do you want to just go to the street and take photos of Our buildings and not follow such a simple procedure Actually if you go to Ministry of Information or ICT board, you can get a letter from Bitange or Paul Kukubo that can even enable you get a waiver on these costs that you are sooo complaining about How do you want to spend a day photographing our buildings and we don't know who the hell you are. I was with a group of Kenyans in Newyork in 2010 and they decided to take pics of a beautiful bridge as we got to NY...we were in a car...and that guy really sweated his small cloth explaining that he is an innocent kenyan on an exchange program.. Such a stereotype that we are all cracking a joke about, happened in 2006-2007 when some people were called " Madoadoa" and you well know what happened in Dec 2007- Feb 2008. Some idiot cops/customs guys harassed me, saying I needed a permit. So I told them to show me where to apply and pay, and reminded them I'd need two more permits for my phones too, since they both have cameras. And I proceeded to ask other travellers if they had permits for their phones too.....I pissed them off so much they had to let me go.
Of course no such permit was required, they were just hoping I'd panic and pay up...

in defense of CCN, though am privy of the drive and am well aware that its a noble idea being a volunteer with Wikimedia ,i want to point out a few things ,if you argue that you don't need to pay because ,you aint making money and if anything you doing Kenya a favor everybody would want to come in the good name of non profit making organization to evade tax. Comparing Nairobi to other cities in the World with less stringent security measures is totally missing the point because ,we are exposed to different security threats and thus the need to approach things differently it,is like saying am putting off my electric fence cz my neighbor doesn't have a fence. My take is that if CCN has been charging exuberant levies to guys calling themselves photographers and using the money to keep our city in the sun clean i have no problem with them and we will do ourselves great favor to pay up and go take the snaps , lest we turn this list into a whining galore!what i know the law or should i say the by laws apply equally across the board , rgds. I actually visited the City council and they advised me that I needed a letter from the Ministry of information!
They usually charge 2600KES per day for taking pictures of buildings and monuments.
I was wondering why they should have such bureaucratic processes while for my case am doing this on a voluntary capacity for a non-commercial endeavor under the umbrella of the Wikimedia Foundation.
After capturing the photos I will upload them to WikiCommons under the CC license.

And I proceeded to ask other travellers if they had permits for their phones too.....I pissed them off so much they had to let me go.
Of course no such permit was required, they were just hoping I'd panic and pay up...

Unfortunately, i think even if you had the neccessary permits you would still be harassed if you are at the wrong place at the wrong time,since the ones enforcing the law dont respect it themselves. So you are perhaps better of taking a chance and not getting any permits just walking around taking pictures. City council licenses are ambiguos to say the least for example a couple of years ago when you'd go to get a business permit, they did not have any IT related categories, all they had were lawyer, doctor, farmer, accountant etc. So tech fell under "miscellaneous". The problem was, there were various types of miscellaneous. One was around 5k per year another was closer to 30k per year. Which one you were billed depended completely on whoever was serving you that day!
