Hello everyone, To those that are familiar with Kenya's legislation, What would I need to abide to in case I was to start an internet based Radio or TV station? For instance do I require some license from CCK? Are there international laws that govern this sector? I do not think so as the internet is not governed by any state ( http://en.wikipedia.org/wiki/Internet#Governance). I would look at it as hosting a website. Different websites have different content... For instance, in order to blog or start a news website, you do not need to be registered at the GPO like kina Nation are, neither do you need any license from any local government authority to start an e-business; likewise, I do not see why the government would need to give you the green-light to launch your own internet radio station. Hello Simon , You are right , the internet is not governed by any state but as Denis had pointed in an earlier thread, “Service provided are governed by Where servers are located and where company is incorporated “. In my opinion as an employer /business you will still have to address the issue of revenue generation ( i.e. Advertising/Marketing/Banking/Taxation/ employment ), and how royalties from broadcasting mainstream music are going to be assessed, among other requirements to operate a successful commercial venture “ Don’t forget that this will be a income generating organization “ that is still subject to Taxation requirements among other requirements to operate a business either locally or where your servers are hosted . I don’t think its going to be possible to be a success without addressing this issues , Unless you officially choose to fly the “pirate” colours on your unregistered trademark . It won’t be long before you attract the wrong media attention that could potentially lead to your servers being shut down or services suspended and as a result your servers will always be on the move. I think without a doubt that if you braodcast from Kenya you need a licence. I will check what the amended Act states and also the exsisting and proposed regulations..... Got to say with all these different opinions, I'm somehow lost mainly when it comes to running the online media streaming as a business entity and where the local laws apply considering the Kenyan locality. I have been doing some more research on this from a different angle in relation to property rights .I have gone through “ Terms of Service” documents for various podcast providers with reference to property rights and getting registered . It’s a good start and will be worthwhile having a read about what they provide, and where you stand as there is so much to choose from. Why stick to the local market when you can go global ? There is also some interesting stuff on Google who plan to AdSense-up viral video hits on YouTube , Once you’ve chosen to enable revenue sharing, YouTube will sell advertising against your video and pay you a revenue share into your Google AdSense account each month. Why I think going local is something?...Coz there is so much untapped local market when it comes to content.That doesn't mean that one cant use global resources to bring in local content into the internet. The question however is... what makes us to rely soooo much on the western world for the simplest things we need when it comes to technology???

Hello everyone,
To those that are familiar with Kenya's legislation,
What would I need to abide to in case I was to start an internet
based
Radio or TV station? For instance do I require some license from CCK or any other body? Are there international laws that govern this sector?
Kindly inform me if you have ever been involved on such or have knowledge of the rounds involved.

Perhaps one could get doing the online radio and tv, while figuring out the legislation (if any). Hey I came across some links while doing some research on this topic . Please note that this information may not be accurate but at least may point you in the right direction . It may be worthwhile looking into The *Internet Radio Equality Act (US)* * and **Digital Millennium Copyright Act<http://en.wikipedia.org/wiki/Digital_Millennium_Copyright_Act> (US). *I cannot find any record of similar acts being passed in Kenya yet , But in my opinion this still apply as they mainly address how royalties should be assessed. Basically if you broadcast music then Statutory license regulations dictate that digital transmissions of public performances of sound recordings need permissions from two sets of copyright owners--the owners of the musical work (usually the songwriter or the composer) and the owners of the sound recordings themselves (usually a record label, unless the artists own their own master recordings ... Yes you will require a licence from CCK if you are going to be broadcasting from within Kenya . Earlier this year President Kibaki's approved changes to the media law, which limits press freedom. Hi chris, as you research on the legal implications of such a service in Kenya ( I assume that this is a grey area blanket-covered by some other ICT legislation in the Kenya ICT Act 2009) , it is worthwhile to note that Kenya's top 2 online stations( 98.4 capital fm and 91.5 homeboyz radio) are hosted at http://www.netro.ca/ . In such a case, they are covered by canadian law and not Kenyan law. Other alternatives include http://shoutcast-hosting.net/. In such situations, services provided by a hosting provider are governed by its where the servers are located or where the company is incorporated.
