I hear there is a sort of epilepsy that is triggered by flashing light, so if such a person was a passenger or driver in a such a car, and the flashes caused an episode, and one gets into an accident, can they then sue both the contractor i.e. Safaricom, and the owner, i.e. Government? But most importantly, would they have a solid case? Extrapolating, can I sue KENHA for not fixing that deep pothole at the beginning of waiyaki way inbound, which has burst my tyre and bent my rim (and several other people's too), yet it is their requirement to fix them?

This has happened in other jurisdiction. Have not yet seen it in Kenya but the cok 2010 allows a citizen to petition for the winding up of a government agency that is not doing its work. In this era of Whatsapp and Telegram, does anyone send SMS anymore? 1500 for SMS? I wish they can price this at 1500 and have the SMS at around 50 bob. Clearly Safaricom has exhausted the need to target other customers (Airtel, Orange) and are now targeting their existing. It’s time to get more creative.

I believe they are called class action lawsuits where many people sue one corporation or a govenment agency in one suit. That way the cost is distributed and they can feel the pinch. On Safaricom tariffs, they are still twice as expensive as Unliminet and in the age of good quality twin Sim phones, I am not sure why people are willing to pay such steep fees.
