Well, I think, just like all telcom operating in Kenya, they have been duly licenced and operating legally. Now unless someone has filed a case in court and proven beyond reasonable double a fraud took place, I still stand to be corrected but Econet is not a fraud. But as I said, I stand to be corrected. I think the government's approach to this issue ( the registration of the identity of mobile phone subscribers) is all wrong because it is reactionary, though its a good thing that something is being done about it. registration of subscribers is all about capturing personal information. What we need is very clear law governing the collection and use of personal information. We failed to take advantage of the opportunity to include such a law in the communications law that came into force on 2nd Jan this year and now we want to patch it up with a presidential directive - even the legal basis for such a directive is very questionable. without denying that there is need to identify the subscribers of mobile phones in order to deter phone-aided crime, there is an even more compelling need for a clear legal framework for the collection, use of and management of personal information. What we need is very clear law governing the collection and use of personal information. We failed to take advantage of the opportunity to include such a law in the communications law that came into force on 2nd Jan this year and now we want to patch it up with a presidential directive - even the legal basis for such a directive is very questionable. without denying that there is need to identify the subscribers of mobile phones in order to deter phone-aided crime, there is an even more compelling need for a clear legal framework for the collection, use of and management of personal information. I think this is a good thing for security reasons. For privacy, you can always use other means of communication. If you think your phone is being monitored, you can always organize to use someone else's phone. There are no shortages of ways to get around being monitored! If you get really paranoid, you can use other means of communication. If this were to be implemented in Kenya, the "organized crime" folks can still beat the system on it. They can always use stolen/forged/fake documents to register their phones. I don't see how the guys selling the SIM cards will be able to verify the information being presented unless we have a central database of the citizens like they have in the United States (or elsewhere) where you need to use your Social Security number for most transactions. In KE, there is no _primary key_ to identify someone. For foreigners, didn't we have the Arturs traveling on fake passports, even? But PIN is not an ideal Primary Key. You need to be a tax payer or to have been one sometime to have a PIN Number, and even then you will need your ID first to get the PIN. We should have a universal system, issued to all Kenyans of all ages, probably at birth. It should also have you DNA signature, finger print, iris scans and so on to make it difficult to forge.
