Dear Brian, I have these issues all the time as I receive gifts for my daughter from the US. Usually I just make a fuss until they reduce them... ie. cry, yell, whatever it takes. It is especially frustrating when we have things donated to the NGO and can't afford to get them from customs as they want to charge full price for them! Customs tax are 25% of value and VAT is 16% of value. So, they can't charge you more than that !! If you are not happy with prices to be paid (by customs officers), you can ask to speak to "the big boss". So I paid a second visit to thebigboss who welcomed me again with ("so what now mzungu don't want to pay tax"). From what I have seen, he is spending his days on Google Shoppping, Amazon and Ebay. So, I ask him to check the value of the item on Amazon and set price based on current market price; which he did within a minute. I brought 2 street dogs here with me from UG (my wife insisted), KRA declared the value of these mutts as 10000 Kshs (actual price paid for dogs=ZERO). I told the KRA lady that if that was the case, I would gladly sell her the dogs, but she didn't bite. I had to pay ~4000 bob just to KRA! I did, once, a long time ago when I was bilaz a PIN. Suffice to say KRA never came close to my spoils :-). Several years before that particular compe, i actually walked into times towers, i think 9th floor, explained my situation to an official, something to the effect that i was anticipating winning some large sums of money, he advised me to write to the commissioner in charge of income tax explaining everything. I never did and neither did I win that particular competition. In my defence, I was a young, foolish and impressionable college student with grossly misplaced patriotic sentiments. The KRA Slogan is : "WE HAVE IT TAKES, TO TAKE WHAT YOU HAVE GOT" Crooks ! I was lucky that there was an error in shipment when I tried to import a phone last year, the DHL service delivered the package to me before the KRA/Customs officials got wind of it. Then they called me, two months later - telling me to pay 11k, for a phone worth Ksh. 6000 [including shipment]. I told them to go rot in pieces [?]! Why should I pay for a single item that is a gift, further more, the value of tax is higher than the value of the good. They told me that they will keep the phone. I told them to keep it ! <they thought they had it> 4 months later, they were still calling asking for the 11k [including keepers fee] - I told them that it will do them good to try and auction the phone and see if they can actually fetch the 11k they are asking for... If they were to fetch more, they could pay me the difference [?] ! In short, for many of us, the taxes are very unjustified [41%] - and this tax is usually waived if you know someone inside. This is not justice.

@Chrystal I did once process items that were shipped by a container from Australia, but I honestly didn't get the documents names...The Ministry Of Finance(MOF) officer was rude to a point that I almost gave up, but you have to get a document from the MOF then give it to KRA for tax exemption... Let me get all the processes and details(forms to fill, officers to see, etc, etc) to give you an informed solution.

It seems like the major problem is lack of communication, and of an official formula for calculating the duties. And since they seem not too bothered to fix this, maybe it's okay to use loopholes. You could try getting your stuff shipped to smaller towns, like for example Kisumu, where there's only one guy who deals with the whole clearing process. And he's never busy. So it would be easier to get him to listen to you. I know someone who got his duty waived after explaining that he was only a student, and the item was a gift. Joseph.
