Skunks: Have you seen Safaricom Innovation Forum Terms and Conditions - http://safaricom.co.ke/innovation/terms.jsp? I am so disturbed by it. It is in my view grossly unfair and wrong. What happens if your innovation is the next money maker? Safaricom has no obligation to work with you and you relinquish your right to benefit from it long term. This can not be right. I am no lawyer, but this can not be right. For ease of reference, please see below and particularly note the first two items: Terms of Idea Submission By Submitting your proposal to Safaricom, you agree: (a) That the submissions and its contents will automatically become the property of Safaricom, without any compensation whatsoever to you; (b) That Safaricom may use or redistribute the submissions and their contents for any purpose and in any way; (c) There is no obligation for Safaricom to review the submission; (d) That there is no obligation on Safaricom to keep any submissions confidential or proprietary. (e) That Safaricom's receipt of the unsolicited idea/proposal does not imply a promise to pay nor a recognition of the novelty or originality of the idea/proposal nor does it establish a relationship which might require Safaricom to pay for the evaluation of the information disclosed in the idea/proposal. (f) That Safaricom accepts no liability whatsoever in receiving any unsolicited ideas/proposals including for any disclosure of the same. (g) That Safaricom shall be fully indemnified from any legal and or other claims made by any third party with regard to the form or substance of any unsolicited idea/proposal submitted to Safaricom. (h) That the any use of Safaricom's intellectual property in the unsolicited idea/proposal has been done without the express consent of Safaricom and shall at all times remain the property of Safaricom and Safaricom does not waive any rights with regard to the ownership and use of its intellectual property. (i) That you acknowledge that similar ideas/proposals may have been submitted to Safaricom and the submitter shall irrevocably waive all rights to institute any legal or other actions against Safaricom with respect to any act or omission on its part related to the idea/proposal. (j) That Safaricom reserves the right to decline any meeting invitation or submission given to it including the submitter's without assigning any reason thereof. I don't know why people pay so much attention to Safaricom. This is a true old-school company, and a dinosaur, in my opinion :) Joseph.

Maybe thats why they have a prominent "Log Out" button on that page ... its shown even if you didn't log in .

I don't know if you can call safcom an old-school company but don't forget the old addage 'He who pays the piper calls the tune' It's very unfortunate but Safaricom have taken such a stance but it's their network and their terms. Well, in this case the piper won't be getting paid anytime soon. Therefore my interpretation of this innovation forum is a place where you give ideas to Safcon for free. Safcom doesn't need anything from you. You are the only one who might need something from them. And since they cant just pick up every idea and sell it for you, that simply want to take it from you and use it because they can and believe u are willing to give it to them. After all, what other company can you take it to. And what can you do about the terms. I think its a bit clear here. Mwenye nguvu mpishe ama akuangushe. If you are not going to buy sth from Safcom, jst dont even think of going there. They r not trying to sooth anyone after all. I actually experienced this first hand... I innocently tried to set up an existing Company (full of engineers ) by hooking them up to Mpesa. So I asked whether Safcom has a till that only dispenses money, but does not receive deposits to serve these traveling engineers with cash from the office instead of the Company always banking on Mpesa kiosks with "no float" or they using ATM cards out in the field.... My question was not answered - which I found a bit rude - instead they sent these 5 or 6 documents with the same legal jargon about "taking your idea and you can do jack to us ...." blah blah... That they will get back to me.... blah blah... Suffice to say,, they never got back to me. I was suddenly treated like some sort of enemy,, no further communication, no response to subsequent emails... And seriously, i dint care about the stupid idea - I just wanted to know whether I can do business. Mabbe the idea was tried out with other pilot companies -- but the guy who wanted it --- Policy "QUARANTINE HIM !!!!"
