Skunks, Suppose I have a company called Chips funga, its website is www.chipsfunga.co.ke. After many years of operation you realize someone else registered a domain chipsfunga.com. He/she has a website www.chipsfunga.com. What are the existing laws existing to prevent this. Gate Keeper stressed

None. Why didn't you protect your brand and register the .com in the first place? Pole either way. -----Original Message----- From: Gate Keeper <mohasq@gmail.com> Sender: skunkworks-bounces@lists.my.co.ke Date: Thu, 5 Apr 2012 14:38:23 To: Skunkworks Mailing List<skunkworks@lists.my.co.ke> Reply-To: Skunkworks Mailing List <skunkworks@lists.my.co.ke> Subject: [Skunkworks] Domain theft _______________________________________________ Skunkworks mailing list Skunkworks@lists.my.co.ke ------------ List info, subscribe/unsubscribe http://lists.my.co.ke/cgi-bin/mailman/listinfo/skunkworks ------------ Skunkworks Rules http://my.co.ke/phpbb/viewtopic.php?f=24&t=94 ------------ Other services @ http://my.co.ke

i dont think he or she has done anything wrong ,so long as you never preserved .com someone else can take it eg i can have chipsfunga.org since its free

The person who did this is advertising a single product similar to the products we offer.

Unfortunately, you are in different legal regimes.....(com and .co.ke) But try send them a cease and desist letter. rgds, 2012/4/5 Gate Keeper <mohasq@gmail.com>

If you feel aggrieved and you have a lot of money, you can take your case to the World Intellectual Property Organization and they will arbitrate.

Just wondering how you came up with 'chipsfunga' as an example -- Be the change you want to see in the world.

@Gate Keeper, Domains are registered on a first-come first-served provided the rights of others are not infringed. However, most TLD administrator provides a mechanism for dispute resolution, mostly through Alternative (or Uniform) Dispute Resolution Policy (ADRP/UDRP). If you feel your rights (commercial or intellectual) are being infringed, you can launch a complain with bodies like WIPO. Let me add to the question. Do we have any provisions in our laws that allow for copyrighting of domain names. I know domains like facebook.com or amazon.com are protected by copyright. Is it possible to register a company that is primarily based on a domain name - like in the case where there is only an online store and no 'Brick and Mortar' shop? yes, there's trademark law.domain names fall under trademark law. one has to show business(or other association) to a name to have greater rights over it. 2012/4/7, Moses Muya <mouzmuyer@gmail.com>:

You can register as long as its free. When registering also look for other domain names that suit your business to avoid them falling to competitors. The only time you can seek legal redress is if the other business is local and is passing off as you. If they are targeting your clients and misleading them to believe they are dealing with you. You operate in the the same region and you need prove to have lost business due to that persons activity. /Bonz On Sun, Apr 8, 2012 at 9:40 PM, Moses Muya <mouzmuyer@gmail.com> wrote:
