<OT>Dealt With Lawyers !!!

Well tried to help myself but couldn't, had to share this from a friend, (1) Did a job, agreed quote [50k] a DB and a website (2) Finished the job, the lawfirm wrote a contract on which the pay was 30k. (3) Pal->What about the 50K we agreed upon?, lawyers-> we never had a contract on that. (4) Lawyers -> take it or leave it 30k cheque is ready after you train us. (5) Pissed he trains vowing never to do this kind of job again (6) After training -> here is your 27k cheque ->we paid 10% to KRA on your behalf. Well this story is so real and so kenyan.... Guys I guess we should all know how to protect ourselves not so much from other business owners but those who seemingly seem to fight for rights (this was a firm that deals with 'human rights of soughts'). Joe, I think and believe we are the smartest of all industries so the worst you could do was to create a bug and when they call you back to fix it, then you demand a new contract. @wilson as I said, it was a friend, though i had similar incidences way back in 06, well, am so mad yet this wasn't me. Its true, contract first, but you will also understand sometimes the jobs are so hard to come by such that when a guy lands something like, especially newly minted techies, they end up being so excited that contracts are nowhere in their minds,and the client can tell this, until they're conned. I think as professionals, main thing is to know what you're worth and value your skills and knowledge appropriately, even if your broke. People, Words of advice from someone who has been shafted more times than he can count: 1) Break the project up into pieces (us consultants call them "Phases') 2) Have a deliverable at the end of each Phase (piece) and a fee to be paid upon delivery *before* the next phase is undertaken 3) Have a down-payment/commitment fee payable in order to start (10%-30%) depending on size of contract and duration 4) Have the client sign off each phase *before* moving on to the next These tips can save a lot of stress, misunderstanding and unnecessary grief. As a freelancer, you should have YOUR OWN contract or SLA that the client signs BEFORE commencement of any work. Actually, I have it on good authority that if you render professional services as a "professional", the person paying you is supposed to deduct 5% and remit it to KRA, I think its called withholding tax or something. Then you as the professional, you can claim back this money from KRA since, theoretically, if you pay income tax on the amount you earned, then you would have been taxed twice. 5% of 30,000 is KES 1500. He should have been paid KES 28,500. But like has been said, never ever write a single line of code without a contract, unless the code is yours.
