WHy is SKunkworks engaging in illegal things? I wonder what the regulatory and enforcement officials whom I know and see here are doing. On Mon, Jul 26, 2010 at 8:30 PM, ndungu stephen <ndungustephen@gmail.com>wrote:

Why is unlocking illegal in Kenya? It has been legal in Canada for a while, and just became legal in the US this week. I presume it is also legal in some parts of Europe as well. Saidi On Mon, Jul 26, 2010 at 3:10 PM, Theus Owicho <owichot@gmail.com> wrote:

Unlocking of modems or phones is not illegal as long as the IMEI remains intact. While it may go contrary to the terms of use by the providers, it is not illegal. In fact most providers would offer unlock codes if requested. i know AT&T, Vodafone and Orange would gladly unlock you BlackBerry is you tell them you are traveling abroad and will need to use it. And Jailbreaking of iPhones has been made an exception to the Digital Millennium Act in the United States, making is legal though I am not sure it was illegal in the first place. Modifying a phone to run different applicaiton or software, which is legally obtained, is legal. I don't know why some get the idea the Communication Acts makes it illegal to unlock a phone or a modem.

Musyoki, Do you have proof this is not ILLEGAL ? On Tue, Jul 27, 2010 at 12:12 PM, Philip Musyoki <pmusyoki@gmail.com> wrote:

Ndungu, inasmuch as i totally loved that movie, i don't think it is admissible in court. Why is it that this topic seems to come up over and over again and everyone seems to have their own opinion. Kwani there aint a skunk lawyer who can tell us explictly what that act states? I thought acts of parliament are written in black and white? Its either illegal or it is not.

Phillip, this<http://www.kenyalaw.org/Downloads/ammentmentacts/THE%20KENYA%20COMMUNICATIONS%20%28AMENDMENT%29%20ACT,%202009.pdf>(PDF, 67 pages) is the act you are referring to right?

Here is what is illegal: 84G (1) Any person who knowingly or intentionally, not being a manufacturer of mobile telephone devices or authorized agent of such manufacturer, changes mobile telephone equipment identity, or interferes with the operation of the mobile telephone equipment identity, commits an offence. This is subject to interpretation, but Identity of a mobile phone is agreed by reasonable people to mean IMEI. Most unlocks do not tempter or change the identity of the equipment. Alvin, it is difficult to proof all things that are NOT illegal, so we just deal with proofing what is illegal.

Bonafide re-programming or possession. 84I. It shall not be an offence under sections 84G and 84H if- (a) the re-programming of mobile telephone equipment identity is done; or (b) the possession of anything that can change the mobile telephone equipment identity is had; bonafides for personal technological pursuits or other technological review endeavours.
