1.there would need to be a clear violation of terms of service dictated by the hosting company. 2. The website would have to be seen to the violate state or federal laws. 2. There would need to be a court order as a result of some Lengthy and Expensive court processes for any other reason.

There are institutions to report hate speech... and since Mashada was hosted in US, believe me, they are plenty of institution to report such website.
I am the one who wrote to White African asking David Kobia (owner of Mashada) to close the website as it was full of hate speech from Kenyan diaspora. I always fail to understand how can someone be praised in one hand for creating a useful platform (Ushahidi) and at the other hand do nothing to stop spread of hate speech and violence. Luckily, WHite African wrote to David who closed Mashada.
It was back on in 2009... but I guess since election are soon... David took the initiative to close it down for a while which is a good thing.
