Two issues that I can see: 1) What if I as an end user of tv station one made a copy off the airwaves and distributed it (Ignore the chance that a broadcast rip might not be as good as a dvd rip)? You'd go to tv station one and claim piracy yet they had nothing to do it with... ergo they can use that argument in court. 2) If it's a watermark, end users will find it and scrub it. What would have happened in this scenario is that we would have sold to say 5 local TV stations who are authorized to show it sometime in future and if any copy found itself in the black market, then we would go and buy it and run it through the watermarker and be able to identify which of the 5 stations did the duplicate and then institute legal action against the specific station.
This would never be a solution for your good old series downloadable from the net, but without digressing from the topic - the original post was actually based on content you have created (or in charge thereof) and not just some stuff on the internet.

Am actually working on a solution (not really a solution but some leverage to deal with pirates) where a video is encoded with an invisible watermark which is unique for every copy made on DVD/CD. If any copy appears on the black market, the software can read the watermark and compare it with the database and know the distributor (who legally acquired it and decided to duplicate). This then is used as evidence to sue the distributor and deal with the root cause of piracy - which is never the guy the innocently buys a pirated copy.
