Each download is space segment off the RBS, Transmission, Core GGSN and to some extend the SGSN. Then you have to make provisions for the Charging System to recognize and bill per MB for particular users. It's an issue when you sell pipes, then you have to put aside resources. But when a user pays for each MB of data he downloads - let him do what he wants - he's paying for it anyways.

Deep packet inspection is routine in most telcos given the volume Torrents are occupying in any given network and safaricom are well within their rights to manage quality.
It's actually a fact that top 10% of users, eat up 80-90% of bandwidth, by any standards this is not acceptable even in a traditional ISP. Don't bother Michael Joseph, he has bigger fish to fry.
