
I think we have established with all certainty that the bug was in the office. That is why Kerich sounds very clear and Amit sounds like he is at a distance - just like a normal phone call sounds. The incoming calls alerts in the middle of the conversation are a bit faint. The phone is also a physical one and not a softphone otherwise we wouldn't be hearing the loud button presses. At this point it is clear that we are dealing with a physical bug and not some computer trojan recording the conversation. Notice something weird, when the call starts, it sounds like Kerich was further away from the phone and the call was very faint but the moment he makes an adjustment the sound becomes clear! Leading me to conclude that the bug was on Kerich and he may have been recording the call himself to use it for something else - leverage? Just to prove my point, if you were making a deal that had the potential of swinging a lot of CORRUPT MONEY your way, would you have it on speakerphone for everyone to hear what you were doing or would you stick it as close as possible to your ear? Think about it! My lawyer friends have alluded to the fact that digital evidence is not admissible in Kenyan courts since it is "too prone to manipulation" These audio clips may not be considered as evidence. Is this information legally actionable? Given that there was no court order issued for the wire-tap of the listening device, can this be used in a Court of Law? As much as he doesn't directly ask for a bribe.
And what about privacy? I assume one has some expectation of privacy when conducting electronic communications.
Now I can relate to the movies where such people have their offices swept for bugs everyday.
