@Brian has a constitutionally granted freedom of expression, which includes freedom to express his *curiosity*. But as is usual, this has a limit. For example, in exercising his right to expression, he may not infringe on the rights of others.
It becomes interesting when you look at the section on equality in the bill of rights, which says that one cannot be discriminated against based on gender, among other things.
So, if @Brian had loads of time and money, he would have a legal backing to sue the said employer, in which case, the employer would have the task of proving to the courts that by employing a male in the said position, that would be infringing on their right... But if they used the same reasons you gave as to the need for a specific gender in a certain position, I doubt if they would have a strong case.
IMHO, companies which advertise a gender specific vacancy are legally ill-informed.
