It also prohibits shooting a car-jacking victim even after they've identified themselves, can't run away (read have already been made to lie down on the ground), but they did so anyway to my cousin last December.
And they didn't just shoot him once, they did so four times at point blank range while he was on the ground next to his car, and killed him.

Sorry for the sad incident, but it's a different scenario when dealing with armed thugs (carjackers). So much is at stake. Lives are in danger on both sides.
If someone is arrested with alcohol, like Dennis, there are no lives threatened.
