@Tusker

Nice one

"Users will have variety. even when they deliver their STB, viewers will tune in to either of the 4 stations, but not all at the same time. "

This is the main reason the delayed, they couldn't agree amongst themselves. As you have said things have changed, everyone needs to rethink their model and fast.

My 21 cents. Digital broadcasting is supposed to allow consumers to watch what they want, when they want. You want Naija Movies, you tune to Naija channel. Before this we had to watch what "broadcasters" scheduled for us. Good Example Citizen. Power breakfast, Afro Sinema, (Live coverage of events.... Graduations....Funerals....ICC Proceding), ADVERTISMENTS, Citizen at 1....bla...bla...bla..mseto......bla bla bla......telemundo......etc

I believe what they should do is to generate content to air. Like CNN and BBC round the hour news coverage. Most of the mainstream media only have news and political debates. other content is what has been always a challenge to them. They need to identify what they do and do it well. They need to understand game has changed. Users will have variety. even when they deliver their STB, viewers will tune in to either of the 4 stations, but not all at the same time.

Whoever who will carry the day will in turn poach the other stations staff and claim they are the leading broadcasters :-)

At the moment they say that the ADNC do not have capacity to distribute their signal all over the country. Who will carry their signal to places they have not set up Base Stations? They will have to invest heavily on building infrastructure & STB. Something PANG, ZUKU have being doing all along as they were still on analogue.

For now they will use their self provisioning licence and the supreme court upheld that "As long as the digital signal distributor does NOT change the content of a broadcast and does not charge the viewers for FTA channels, then there is no copyright infringement"  I do not know whether then it would be illegal for the star times and GoTV to broadcast the you tube content of the live streams??

My take is that the game is changing and it is changing real fast. The sooner they react the better for them. streaming news on you tube is only for the people who have devices that can access unlimited internet.

@Stephen not sure how the ADNC issue will play out because currently they are all riding on an FTA licences for content provider  meaning they cannot scramble the signal .For that to happen they will need to apply for pay tv licence.

As @Alex has pointed out who determines what FTA to carry and if there are any agreements required between the BSD and FTA's  this is still not clear to me

Still trying to figure out the overall strategy here for ADNC if there is any... my 2cents they want to control the distribution of their channels that way they have control of audience data which is vital for the advertising revenue stream

@simon

Then can we assume, if ADNC, decide not scramble their signal, then by law, the Gotv Decoder and Star times decoder should be able to receive their signals?

What will the 5 FTA channels be in ADNC? now that they only have a total of 10 channels

Third party includes FTA yes

Also the "must carry rule" applies for the Self provisioning license which according to DG is set at a minimum of 5 FTAs in addition to their exclusive content.

These 5 should not be charged for access. That's why GOTV and Star times had to get the open decoder options -what is been referred to as "administration fees" here

@Alex yes the decoder can be both FTA and have conditional access. Bamba decoder has both

Third party content (or is it second party) is the channels in this case (Lolwe, Njata, EBRU etc)  and this is FTA (not sure it can be non-FTA) but if it was the decoder wouldn't be FTA since the content provider would have to enforce conditional access (CA) and this is enforced at STB level.

And "third party content" doesn't include FTA, right?

Now, help me understand who is the third party, especially if the signal is scrambled?

Then again, they are not the same; two licenses are at play

(Self provisioning license - They cannot transmit third party content, only their content)
(Broadcast Signal Distributor - They transmit third party content, are ideally not content providers)

DSTV which transmits as GoTV - Self provisioning license
PANG which transmits as PANG also owns Startimes  - Broadcast Signal Distributor
BAMBA - radio africa group - Self provisioning license
SIGNET- an arm of KBC - Broadcast Signal Distributor
then finally we have ADNC -Self provisioning license

Now, the big question is why would ADNC be interested in signal distribution since they cannot offer it as a service and hence will only incur additional cost of network maintenance without any revenues generated.

All the STBs licensed by CA are for receiving, primarily, the FTAs.

So, let's start with the Bamba (from Radio Africa Group). It is supposed to and was sreceiving the FTAs before the self-switch-off.

1. Does the Startimes STB receive SIGNET channels? Sorry, I don't have it so I don't know.
2. Does the GoTV STB receive SIGNET channels? I think it does, but I need to verify tonight:)
3. The govt STB is which one??
4. My Sony Digital TV receives GoTV, Startimes, SIGNET, Bamba and some other signals there.... but the scrambling of some of them obviously is the issue.

Also maybe we can do a research here,

Does the Startimes STB receive signet channels?
Does the GoTV STB receive signet channels?
I know that the Government STB recieves both STV and GOTV save for the scrambling issue.
The digital TV is equivalent to the govt recommended STB

So the last question is this, if KTN,NTV and Citizen were to invest in the transmission equipment, what would stop the current STB from receiving their signal?

I remember GoTV asking for a one time "administration fee" of about 1,500 or something close for them to allow you to watch FTA channels even when your subscription is expired. Did this change?

@James - the pay TV license is different from the digital distribution licence - thats why DSTV can prevent you if you don't pay but GoTV cannot prevent you from the FTA channels if you don't pay, yet technically the company is one

What does the sale of the STBs got to do with in in your opinion?
Didn't the Cartel already know that CCK (CA) licensed about 60 distributors for the STBs (non-subscription) ?

How has DSTV satellite broadcasting been delivering KTN,NTV and Citizen to their viewers in remote areas, inclusive of neighboring countries, prior to all this problems beginning, was it illegal?
