I think this is a very myopic view point. Getting infrastructure for this sort of initiative will require cooperation of big business -- ISPs, Telcos etc and starting off from the get go as an illegal file sharing network immediately eliminates their participation

To me, the morality of whether a download is legal or illegal is inconsequential. I believe an effort to develop an infrastructure for exchanging, downloading and sharing big files is invaluable. In whichever form, it will allow for download of both legal and not so legal files. 

What do you guys think?
