
@ Wash ...the sex started with consent but ended without consent. So the guy is first using a condom.....then the condom bursts.....he is told to get out but he continues......(so he continued without consent)...at that particular time when the condom bursts it is against the will of the lady (which is rape). What does this "sex by surprise" mean? Supposing - That you promise to use a condom, then the lady discovers that you actually did not get round to wearing the condom, and so takes you to court? Where would the proof come from??
