The only time you will have a guarantee for getting back your phone is if there is some tiny font somewhere in their contract that says "In the event we do not find it we shall buy you a similar device". Bottom line is that it depends on who stole your phone. If they are wajanja enough, you wont get it back. Thats a guarantee.
