I dont know what the current dispute resolution policy says - hence it would probably require legal interpretation. IMHO www.safaricon.co.ke is not safaricom.co.ke hence the issue of registration "in bad faith" would only come into play if they were using the said content on a domain like safaricom.or.ke or something similar to safaricom. Do you remember the story of www.whitehouse.gov, whitehouse.org and www.whitehouse.gov?. If not http://en.wikipedia.org/wiki/Whitehouse.com IMHO, where the name is different that cannot be interpreted to be in bad faith since the domain or the name safaricon doesnt belong to them. In other words, the same folks can go and register a domain with a completely different name and still achieve the same objectives. KENIC would have no grounds to shut them down. So if the posting is correct, they are likely going to go to an TLD outside Kenya (see above whitehouse.gov story) so it would be a different level of engagement for Safaricom when someone registers safaricon.com which as we speak is open for registration! :| KENIC are likely to open a pandora's box because it means anyone who registers a name in future like safaricom.or.ke or safaricon.or.ke will likely have a problem too. wont they? my 2 cents!
