This sounds to me like a willing buyer willing seller basis, when you download their ringtones (when easily, you can feed ringtone songs via USB cable to your phone for free), you should also expect to keep them in business so that the service is available at a future date. (assuming the sim card was from your phone)
Just accept the verdict in the terms (that you probably ticked "I have read terms and conditions" without reading a single line) and move on, no one conned you.
