1. The Constitution provides for the right to privacy under the Bill of Rights. Data protection law is work in progress.
2. You may not be held liable for now on how users use your system though you should at least put in place a 'acceptable/fair use' policy. However, in the event misuse happens, you'd be required to assist in containing such as occurrence. See the Kenya Information and Communications Act CAP411A - chapter in e-transactions.
