Listers, We hope you are all well post POTUS visit. Due to the the national activities last week, we were not able to post the last issue for discussion. Many of you had requested for a discussion on openness of the Internet and so we shall tackle that today. You are also welcome to contribute to all the other discussion threads from last week as we gear up for the face to face KeIGF . The idea of an open Internet is the idea that the full resources of the Internet and means to operate on it are easily accessible to all individuals and companies. This often includes ideas such as net neutrality, open standards, transparency, lack of Internet censorship, and low barriers to entry. We seek to answer questions like: how open is the Internet in Kenya? Is Freedom of Speech Online encouraged or it is suppressed? Are there examples of blocked websites in Kenya? How easy is it to start an Internet business in Kenya? Should Internet service provider (ISP) be allowed to speed up, slow down or block lawful Web traffic from getting to where you, the customer, want it to go? Should ISPs like Orange or Safaricom demand payment from content providers like Facebook or Google because these content providers reap huge profit from the infrastructure provided by ISPs? Ali, Its true, free services could harm competition and distort markets. Are there zero rated services in Kenya? If I'm not wrong, Wikipedia is free on Safaricom and Orange and Facebook is free on Airtel. Cdohnio, actually, ISPs are paid by three parties in the information exchange handshake. The receiver, the sender, and the host/content-provider of the information. So I don't see why the content provider should pay twice, first to have pipes connected at their servers, and for users to access the said content. Still on openness, how open is our business environment for existing players to get licenses and for new players to enter the market? I've heard some ISPs complain that they are denied licenses by the regulator, or the licences are too expensive. A case in point being the 4G lisence.

You have captured the point right from my thoughts. We need to find a balance between regulation and over regulation. Innovations like Mpesa thrived because the environment was ripe and there were no stifling policies (barriers to entry) Consumer protection: Article 46 of our Constitution on Consumer Protection mandate Parliament to "...enact legislation to provide for consumer protection and for fair, honest and decent advertising." The firth schedule envisioned this enactment to happen four years after the promulgation, which I believe is expired. But that not withstanding, any court of competed jurisdiction should be able to rule and set precedence on consumer protection issues. Therefore there is NO vacuum at all. Bill of Rights: Consumer rights. 46. (1) Consumers have the right— (a) to goods and services of reasonable quality; (b) to the information necessary for them to gain full benefit from goods and services; (c) to the protection of their health, safety, and economic interests; and (d) to compensation for loss or injury arising from defects in goods or services.

Many thanks Fred and Grace for contributing to the discussion thread. We welcome more input from colleagues as we move along. A while back i came across information that COFEK was working on a Consumer protection act similar to the South African one. It would be good to know where they reached or got stuck. The Communications Authority had also launched a series of campaigns to protect consumers which seem to have slowed down after the organization re-branded. However it would be usefull to know the impact such initiatives made in the sector as well. It is my hope that we can get an update from COFEK on the progress made with the bill. There abt 30m subscribers in Kenya..so 1m is about 3.3%. I have about 1620 contacts on my phonebook.. so ideally 54 of them should be on Equitel prefix. On avarage I do about 30 calls a day..again it means at least one call shud be from an Equitel prefix...unfortunately that's not the case. Thank you everyone for the enriching contributions.Without cybersecurity, users cannot be assured when transacting online. A special mention to the security experts who have interesting and practical views to the cybersecurity issues. We may need to seek more information from those in bodies such as ICTA, from experts who helped to set up the systems as well as from private sector. Would be interesting to hear how banks achieve security, especially with Internet and mobile banking. The issue of mobile money payments will be part of our discussion tomorrow as we tackle "the Internet Economy". The discussions on all the topics remain open so please continue on. We shall pick all the recommendations and suggestions and present them to stakeholders during the IGF. Hopefully, some of them will find their way into policy and use in our institutions. Very interesting turn the discussion has taken. Understandably, Equitel is something to watch as it could disrupt the market. many hope it will. Are techies here telling us that the security of using Equitel SIM cannot be guaranteed unless there are strict internal controls? Does this mean we already need laws for what is quite a novel application in Kenya? @fredrick, GSM is intentionally flawed in the core to allow for LI (lawful interceptions). Dear Listers, Kenya has had its fair share of high profile cyber threats, hacking etc, the latest being the alleged compromise of the IFMIS system at NYS/Ministry of Devolution. The country and Africa at large is making efforts to assure cyber-security. These include among others her involvement in the Africa Union Convention on Cybercrime and a proposal for a Cybercrime law, an initiative led by the Office of the Director of Public Prosecutions. Significant financial resources have also been earmarked by government for security and cyber security in particular. There are also partnerships between government and private sector in deploying cybersecurity centres. The private sector has employed practical measures to protect their businesses. However, businesses such as mobile money providers and banks have been shy to divulge their cyber security concerns to protect their interests. Civil society on the other hand has raised concern about the line between protecting the cyber space and creating a facilitative environment for innovators as well as protecting the rights of users. Are our efforts at deterring cyber-crime the correct way to assure cyber security? Are fears about a partnership between government and private sector and the general fears about stifling innovation and human rights in the name of cybersecurity legitimate? Concerns. 1. Lack of enterprise security architecture framework or Security Program Strategy. This is a methodology for addressing security concerns at every and each architecture domain. The existing enterprise architecture and security architecture frameworks are not quite there yet or non-existent. The legislative arms of the government fall here too. If the architecture exist, then its is viewed as a panacea, no actioning is needed, e.g the password policy. It is general knowledge on how it should be done but implementation is shelf-based. 2. Lack of alignment with both business, IT, operations and regulatory,therefore,a need to transform the security organization, i.e placing the security capabilities as a subset of the business reference model to give understanding of how they fit within the strategy,organizational units, business functions and processes. 3. Legal regulatory and internal compliance(stakeholder business objectives and investment) conflicts . The increasing number and scope of regulatory requirements often can override business objectives or internal compliance and affects core business capabilities. Security is the viewed as hindrance. 4. A need for business-outcome-focused and risk-driven security reference architectures. In our enterprise security architecture framework, risk and business objectives are the key drivers for the selection of security controls. As this is a top-down approach, it ensures that all policies and controls are identified and owned. 5. Emerging trends and technologies, such as IoT,cloud, BYOD and mobility affect data privacy. The challenge is gaining knowledge around the relation to data privacy requirements, threat and vulnerability vectors and business objectives. Having a proper security program/architecture sanctioned by the stakeholders and mostly importantly, the executive management and the government legislation(of course without the evident greed governments) will trickle down to every unit and person. I've been disturbed by the Airtel's claims that Safaricom is dominant. I am no apologist for Safaricom but would not defend the claim that I admire how organised they are. In order for Airtel's claim to be sustained, they would have to show that they has been equally competitive. They would have to show that it is primarily due to Safaricom's supposed dominance and not their lack of innovation that has let to them being uncompetitive. I think that is a very tough call for them given than they have changed hands thrice (Kencell to Celtel to Zain to Airtel). They would have to show that these brand changes have not had any adverse effect on their market position. Airtel is a pan-African corporation and it could also be the case that their market strategy is homogenous and disregards local cultural differences (given that Kenyans have 'peculiar' habits). I am not aware that Airtel (or any of its previous incarnations) has ever returned a remarkable profit. I only recall once seeing mention of Ksh.64 million profit in either 2006 or 2007. There are serious consequences riding on this decision. For one, a verdict of Safaricom being dominant will communicate to the market that there are size limits that the government should impose on corporate growth, which could keep multinationals at bay. It will be very interesting to see what the relevant authorities rule. If anyone has information to the contrary on the above, I stand corrected. -- Regards, Paul K. HTC M7 Microphone Issue

Morning Skunks, I have an M7 that suddenly developed an issue. Whenever I pick a call, the person on the other end can not hear me unless I use earphones or put it on speaker. Some forums point it to a software issue but I've tried everything suggested and nothing has worked. Any ideas? -- Regards, Fernandes Thuita.

I also have noted that most networks are more concerned at mitigating external hackers. There is no access controls for internal workers such that anyone within the internal network has an unlimited access to information some of which they should not be privy to. There is little enforcement from the network perspective of the resources any particular internal user has access to. Listers, Since promulgation of the Constitution, Kenya has become a litigious society, and the ICT/Internet sector has not been spared. For instance, the processes used to constitute public ICT bodies was contested while a good part of the digital migration process also played out in the public galleries. Looking at Kenya's past journey in ICT/Internet governance, has it been inclusive? Are we presently adhering to Article 10 on public participation in local Internet governance matters? Do the present mechanisms facilitate meaningful participation of all including those with disabilities? What are the roles of the various stakeholders and are they all playing their roles? Is the ICT environment in Kenya inclusive—that is, with an atmosphere in which all people feel valued and respected and have access to the same opportunities? What is the state of Universal Access and implementation of Universal Service Fund in Kenya? Are the USF Council members representative of the Internet community in Kenya? Nexus 5 camera bug

Hey Skunks, I've been experiencing this issue since I upgraded to android 5. I'm currently on 5.1.1 but the bug still exists. Initially, the camera would start fine for a few minutes then crash. A restart usually fixed. But now, the flash and the camera no longer work. Anyone with the same problem who managed to fix it? I've tried all suggestions on xda but none seems to work. KR, Joseph.

As is our tradition, we shall engage in online discussions prior to the face to face meeting. The discussions also provide an opportunity for deeper analysis of issues by listers as more time and space is available to bring out different aspects of the topics that form part of the KeIGF programme. Greetings, The Kenyan Internet Governance Forum ( IGF) will be held on 31st July 2015 from 8.00am at the Stanley Hotel, Nairobi. We encourage you to confirm attendance through the eventbrite page http://www.eventbrite.com/e/kenya-internet-governance-forum-2015-edition-ti… Before the forum, there shall be online discussions from 20th to 25th July whose outcome will form a basis for the physical meeting. We intend to use these lists during the discussions. kictanet(a)lists.kictanet.or.ke, skunkworks(a)lists.my.co.ke, isoc(a)lists.my.co.ke. For the Cybersecurity and Trust theme, we will also use the list security(a)lists.my.co.ke The online moderators will be Barrack Otieno and Grace Mutung'u. Each day, we will strive to get domain experts to help balance the debates and give them perspective. If there are any questions you would like answered during the online discussions or physical meeting, don't hesitate to reply to the list. Below are the sub-themes for the online discussions and a prologue of what to expect. Day One: 20th July 2015 Inclusiveness and Diversity: Is the ICT environment in Kenya inclusive—that is, with an atmosphere in which all people feel valued and respected and have access to the same opportunities? There have been several court cases in ICT/Internet space in the recent past where litigants lodged complaints about the processes used to constitute public bodies. A good part of the digital migration process also played out in the public galleries and in court. Looking at Kenya's past journey in ICT/Internet governance, has it been inclusive? Are we presently adhering to Article 10 on public participation in local Internet governance matters? Do the present mechanisms facilitate participation of all including those with disabilities? What is the state of Universal Access and implementation of Universal Service Fund in Kenya? Are the USF Council members representative of the Internet community in Kenya? Are all stakeholders' interests taken into consideration in forming the USF council? Day Two: 21st July 2015 Cyber Security and Trust: Kenya has had its fair share of high profile cyber threats, hacking etc, the latest being the alleged compromise of the IFMIS system at NYS. The country and Africa at large is making efforts to assure cyber-security. These include among others her involvement in the Africa Union Convention on Cybercrime and a proposal for a Cybercrime law, an initiative led by the Office of the Director of Public Prosecutions. Significant financial resources have also been earmarked by government for security and cyber security in particular. There are also partnerships between government and private sector in deploying cybersecurity centers. The private sector has employed practical measures to protect their businesses. However, businesses such as mobile money providers and banks have been shy to divulge their cyber security concerns to protect their interests. Civil society on the other hand has raised concern about the line between protecting the cyber space and creating a facilitative environment for innovators as well as protecting the rights of users. Are our efforts at deterring cyber-crime the correct way to assure cyber security? Are fears about a partnership between government and private sector and the general fears about stifling innovation and human rights in the name of cybersecurity legitimate? Are there other practical approaches that different stakeholders can take to enhance cyber security? Day Three:22nd July 2015 Internet Economy: The rise of the Internet economy in Kenya has been defined by different strokes. On the one hand there are small entrepreneurs doing their side hustles from offices, small shops and car boots. They advertise their merchandise and services on social media and in a rudimentary form, some deliver merchandise in backpacks from door to door. Enter the bigger players who have large websites from where goods and services are purchased. Their business models differ. There are those such as OLX that provide a platform for users to interact. They make their money from adverting. Others such as Rupu and Jumia offer services and merchandise on reduced prices. Is there an adequate legal framework to protect consumers from fraud, deficient goods and services and to assure consumer rights in the Internet economy? Since the larger companies are doing well, is time ripe for the local Internet economy to be taxed to raise money for government services? Should other services in the Internet economy such as cloud services, international online purchases etc be taxed? Day Four:23rd July 2015 Critical Internet Resources: Is there an over arching national policy to guide infrastructure deployments within the country? What is the current state of fiber optic cables across the country? Is there any redundancy on the cables laid across the country? Are there policies in place for infrastructure sharing to avoid each operator laying their own cable thus passing the cost to the end user? What is the state of IXPs in Kenya? Where are we in keeping local traffic local as compared to say 2 years ago? Communications Authority requires all .ke registrars and the registry to be licensed by it before they commence business. Why is the registry being licensed? What would happen if CA withdrew the license for the registry? Why are registrars licensed twice, first by KENIC, then CA? Will over regulation hurt the industry? With the eminent depletion of IPv4 addressees around the world, what is the state of uptake of IPv6 addresses in Kenya? What is being done to ensure there is more uptake of IPv6? Then there is the exhaustion of IPv4 in some regions of the world like ARIN forcing them to go full V6 without dualstacking, what impact does that have to our country where most networks and content is on v4? Day Five :25th July 2015 Emerging Issues This topic attempts to provide the space to discuss a variety of emerging issues in the Internet space. For instance, the mandate of WSIS, a meeting of the UN that took place in 2005 in Tunis is coming to an end. WSIS process, started gave birth to the Internet Governance Forum (IGF) which is up for renewal end of this year. >From IGF discussions, there are no concrete proposals to form a permanent UN body for Internet governance. However, the discussions have borne many policies or “soft laws” that have guided relationships various stakeholders. Should the mandate of WSIS be extended for a further 10 years? Should the government of Kenya support a renewal of WSIS? Day Five and day 6 :25th-26th July 2015 Openness: "The idea of an open Internet is the idea that the full resources of the Internet and means to operate on it are easily accessible to all individuals and companies. This often includes ideas such as net neutrality, open standards, transparency, lack of Internet censorship, and low barriers to entry". We seek to answer questions like: how open is the Internet in Kenya? Is Freedom of Speech Online encouraged or it is suppressed? Are there examples of blocked websites in Kenya? How easy is it to start an Internet business in Kenya? Should Internet service provider (ISP) be allowed to speed up, slow down or block lawful Web traffic from getting to where you, the customer, want it to go? Should ISPs like Orange or Safaricom demand payment from content providers like Facebook or Google because these content providers reap huge profit from the infrastructure provided by ISPs? What is the position of the regulator on net neutrality? What is the position of service providers in Kenya on net neutrality?
