A few folks have pointed out that the act of promoting a particular proposal contradicts the ITU's depiction of the secretariat as a neutral arbiter of the process. Here is a tweet from ETNO, announcing the planned "storm": https://twitter.com/ETNOAssociation/status/255684963389825025 We plan to do some strategic "counter tweeting" here at CDT, and we think it would be great if others do the same. Use hashtags and #ITU #WCIT and tweet at @ITU and/or @lgambardella to participate. Discussion intermediary liability in Kenya

Dear Colleagues, This is an invitation to a discussion on intermediary liability in Kenya starting tomorrow Tuesday 2nd October 2012, which will be followed by a breakfast meeting on 10th October at jacaranda hotel. See attached the initial findings of the study on Intermediary Liability in Kenya. We welcome comments. Please note that this initial report is a forthcoming publication, and it should not be cited publicly until November, when the final report will be made available. The study notes that there is a lack of a clear framework for liability of intermediaries and a lot of uncertainty in understanding our evolving post-constitution legislative environment particularly in "regards to what offenses may happen on communications networks and whether intermediaries would be liable or not, this may have contributed to caution and self-regulation. In addition, there seems to be no legislated take down procedures other than responding in court to whichever law was cited as broken. Do we need a "clear framework for liability of intermediaries, and safe harbor legislation? What are the strengths and weaknesses of the current situation? We would like to encourage policy discussions on these issues with the aim of providing concrete recommendations and way forward. Let us recall the key points of the ETNO proposal and see how they fare: a) Sending Party Network Pays: * No chance for survival b) Prevent national governments from mandating network neutrality * governments will not accede to an international treaty limiting their choices in this respect c) allow commercial agreements on QoS based charging * no need to put this into an international treaty as the right to conclude commercial agreements already exists and nothing in the existing ITRs prevents anyone from doing so today d) help telco operators with their broadband investment issues * this issue needs to be addresses to national and regional regulators and does not need to be in an international treaty. Washington I beg to differ. Changing the name alone would be akin to putting a leopard's skin on a sheep and expect it to bite. What this new bill (if the news story is to be believed) seeks to do will be a game changer, though I will hold my substantive comments until I have seen it. From the story it seems that we will finally have a commission fashioned to some extent like the European and American ones with real teeth. May be then we will stop hearing stories about politicians trying to influence CCK, CCK pussyfooting around key issues because they don't want to be seen offending the powers that be. By the way, having said all that I must commend CCK for steering the sector up to now. Within the confines of the law and the current dispensation they have done a commendable job. May be it's time for the child to move on? Out of the parents home? My two cowries.. Listers, The Internet Society Kenya Chapter will be coordinating the local remote hubs, this is an appeal to our colleagues in Universities or any interested institutions who might be in a position to set up the hubs to pass the message to interested participants within their communities. There are several advantages in creating a hub: - it helps to raise awareness about Internet Governance issues; - it fosters networking among participants and community building; - and it encourages follow-up activities. There are those who are of the view that the ITRs should remain as they are. Another school of thought argues that a review is necessary but should be minimal, only addressing those provisions that have been overtaken by technological and market developments. The third school argues that review should be extensive as the global telecoms industry has changed enormously since 1988. The outcome of WCIT-12 will be a product of negotiations/trade-off between these three schools of thought. Dear Listers, Africa Top Level Domains Organization (AfTLD) in collaboration with the Zambia Information and Communications Technology Authority (ZICTA), hosted the 6th annual ccTLD event in Livingstone (Zambia) in July 2012 the theme being Enhancing Internet Management in Africa. While presiding over the opening ceremony the Minister of Transport, Works Supply and communications urged delegates to ensure that the Internet is readily accessible and manageable to the ordinary person in an African village, in addition he emphasised on the need to curb the digital divide between urban and rural areas and the high cost of Internet services in African countries. The meeting focused on enhancing the visibility of African ccTLDs through branding and marketing, examining the likely impact of new gTLDs on African ccTLDS as well enhancing the robustness and efficiency of African registries by improving technical infrastructure. The meeting was in line with AfTLD’s strategic objective of building capacity of African ccTLDs with an aim of improving and enhancing Africa’s internet infrastructure. During the meeting Mr. Vika Mpisane (.ZA) stepped down as AfTLD Chairman, Mrs. Mary Uduma (.NG ) and Mr. Eric Akumiah (.GH) were elected as members of the Executive Committee. Best Regards Dear all, The IGF Secretariat has approached us and suggested encouraging ISOC Chapters setting up Remote Hubs for next month's IGF meeting in Baku. I am ware that some Chapters have dome so in the past and we would very much welcome if more Chapters chose to set up a Remote Hub for the Baku meeting . This is would be a welcome opportunity for ISOC members who are unable to travel to Baku to engage with the IGF and to contribute to the discussions taking place there. More details about how to set up and organize a hub can be found on the IGF website: http://www.intgovforum.org/cms/remote-participation/hubs-instructions Past experience has shown that it usually works well when the hubs are set up in cooperation with a school or an academic institution, preferably a technical college. Happy Tuesday! Strange things happen with the right business incentive - like our mobile companies coming together on this matter! Yesterday DN cited that CCK would compensate providers for cost associated with this process. However the good compensation is not rolling on to the consumers. Ports of entry are not manned by civilians! The government has a role. Any chance this is a replay of the generic medicine sagas years back when generics were taking over the market for major players thus were being labeled as fakes? Today, the generics save many lives within our communities. Will this give undue reason to stifle entry by new phone providers or even local innovators? Will this now kill-out the many entrepreneurs running mobile shops across the country as consumer confidence is lost due to the bad PR in favour of service provider shops and dealerships? The "Unspoken" is speaking louder than the spoken in this matter. Surprisingly COFEK has taken a back-seat on this and it hits directly at consumers pockets. The big question that is not being answered is still how and why we got here. With all the said health and security issues being given now on the counterfeit phones how comes the relevant agencies did not act before to curtail entry into the country. Why did telcoms enable the phones in the first place? Unless this information is a new science discovery. By the time a consignment of counterfeit products is in the high seas and getting into Kenya, the original manufacturer or Kenyan agency using their own internal intelligence is more often than not already aware . Even for counterfeit food products, most are nipped before being disposed into the mass market. It hurts your business and one of the principles in business is protecting your niche. Unless we say manufacturers are not intelligence savvy or have other market interests. This puts a lot of weight weight to the school of thought that the counterfeit industry is a sector on its own. This may mean that it is promoted not only by the counterfeit manufacturer and consumer but by other silent stakeholders. Yes, it is possible to be holding one of the "counterfeit phones" considering that most of the purchases in Kenya are done in the many mini-phone shops spread across our towns. And the phones have as many stickers indicating "original" and warranty forms as the ones in the main phone dealers shop! Driving this conversation on to internet spread, it means that one of the days, the drive will be on counterfeit computers - the main tool for internet access across our communities (The phone is also increasingly in use). We need to start managing key questions; Whats the implication in making the internet for all? Whats the mitigation? and many more. Have a great week. This is good news, but the Gov. <KBS> should escalate their acts. Two years ago I bought a phone for 4K, but dint last two hours. I tried to return it to the seller to no avail, the cops also wouldn't help. I simply threw it away. Before the announcement, how would innocent people distinguish between fake and original? I think it is unfair to switch off unless there are some plans for compensation. Why do we allow them in, in the first place? Then how can consumers seek redress in case of complaint? Do we have legal mechanisms, rather than be told to go report to KBS office to lodge complaint. What if am residing in Turkana or Mandera? Won't the cost of travel be double the cost of the phone? Can we then say that our fundamental human rights are not adequately being addressed. I think its is time order was brought in to protect the general innocent public from suffering.
