Online Imposters

Good morning Listers Yesterday we had a stimulating debate on prosecuting hate speech online. Ali Hussein pointed out that what is wrong offline is also wrong online and gave the example of impersonation. Today, we want to focus our attention on online imposters. We have had cases of imposters creating facebook and twitter accounts of known personalities for example of the former government spokesperson Alfred Mutua, Comedian Churchill aka Mwalimu King’gang’ and several politicians. The police have also been impersonated on twitter. In such a case, where is the place of ethics and personal values especially when impersonating other people online? Is there a provision of personal values in our constitution or in any or our legislation that can provide guidance on how to handle online imposters? How should such matters be dealt with? Lets hear it from you. This is the second last day to contribute as we will be winding up this debate tomorrow. Thanks Ali, Barrack and Jaco. The message is clear: the education system as well as intermediaries have a role in educating users of their responsibility online. Listers, please feel free to continue the debate under the thread of Hate text messages/KICA Section 29‏. Today, we focus our attention to prosecution of online hate speech. The NCIC has threatened to prosecute online hate speech as political campaigns intensify ahead of the 2013 March general elections. The Chair of NCIS was quoted in yesterday’s Daily Nation as saying that his Commission is working with cyber cafes to monitor hate speech. There seems to be uncertainty on what offences may happen on communication networks and whether intermediaries would be liable or not. Such intermediaries as Safaricom have come up with rules that will be applied for political advertising on its network; while Nation Media has NMG blog rules (see http://www.nation.co.ke/meta/-/1194/1132038/-/88lbspz/-/index.html) NMG is cautious in particular after being sued for comments made by a reader on its blog on a story about Uhuru Kenyatta. Is it advisable for these intermediaries to take caution or encourage self regulation or what should they do? How successful do you think the NCIC will be in prosecuting online hate speech? I beleive this is meant to ensure that the Intermediary is responsible for the content emanating from the network? if this is the case, why shouldn't the government which has a responsibility over the safety and security of every citizen not take the intermediary to court to produce the the real culprit? Lordmwesh, I don'tthink its a question of putting weight on Intermediaries but making them aware of their roles and responsibilities with respect to informing educating and entertaining, freedom without responsibility is a recipe for chaos, better to arrest the situation before it gets out of hand, you realise how information has made the public more difficult to deal with by law enforcement agencies, the same freedom can be an Achilles heel to intermediaries one of the Intermediary representatives alluded to the fact that if we are not careful litigants with the money and know how can bring down the biggest of corporations through Law suits. Grants Available for ICT-based Projects!The Swedish organization SPIDER offers catalytic seed funding to innovative ICT4D projects in partner countries, within their thematic areas and crosscutting ICT4D priorities. Innovative and experimental projects are encouraged, along with strategic interventions in specific areas. Projects that generate good results are expected to be upscaled. SPIDER’s thematic areas: democracy: e-government, e-governance and ICT for empowerment; education: education management, e-learning and digital literacy; and health: healthcare management, e-health and public health. They work on cross-cutting ICT issues such as low cost and high quality technology, free and open source software (FOSS) and mobile technology for development (M4D). Their main focus in terms of development issues is in youth empowerment, cultural creativity, and capacity development. SPIDER works primarily with twelve priority countries for Swedish development cooperation: Bangladesh, Bolivia, Burkina Faso, Cambodia, Ethiopia, Kenya, Mali, Mozambique, Rwanda, Tanzania, Uganda, and Zambia. Organizations from partner countries can apply for funding at any time, by submitting a concept note. On some occasions, SPIDER will also announce open calls for applications on specific areas of interest. In this connection the Ministry of Communications and Information Technologies of the Republic of Azerbaijan is now kindly offering reimbursement for visa fee charged to all IGF participants. As promised by Alice, we would like to continue with this discussion for this week. As Kenya prepares for elections next year, and with all the political alignments taking place, we are likely to see intermediaries being blamed for carrying utterances of our politicians. The media has been blamed many times by politicians for ‘misquoting’ them yet in many instances there is video footage to confirm that the politicians did indeed say certain things. For those who watched the youtube video that ridiculed Prophet Muhammad and resulted in the killing of Christopher Stephens, the US ambassador to Libya and three American members of his staff by angry protesters (or lynch mob as some people called them), who would you say was wrong or where would you place the responsibility for this eventuality? Would you say it is the video producers or or youtube or who? Lets hear it from you listers.
