Dear Listers, Kenya has had its fair share of high profile cyber threats, hacking etc, the latest being the alleged compromise of the IFMIS system at NYS/Ministry of Devolution. The country and Africa at large is making efforts to assure cyber-security. These include among others her involvement in the Africa Union Convention on Cybercrime and a proposal for a Cybercrime law, an initiative led by the Office of the Director of Public Prosecutions. Significant financial resources have also been earmarked by government for security and cyber security in particular. There are also partnerships between government and private sector in deploying cybersecurity centres. The private sector has employed practical measures to protect their businesses. However, businesses such as mobile money providers and banks have been shy to divulge their cyber security concerns to protect their interests. Civil society on the other hand has raised concern about the line between protecting the cyber space and creating a facilitative environment for innovators as well as protecting the rights of users. Are our efforts at deterring cyber-crime the correct way to assure cyber security? Are fears about a partnership between government and private sector and the general fears about stifling innovation and human rights in the name of cybersecurity legitimate? Greetings, The Kenyan Internet Governance Forum ( IGF) will be held on 31st July 2015 from 8.00am at the Stanley Hotel, Nairobi. For the Cybersecurity and Trust theme, we will also use the list security(a)lists.my.co.ke The online moderators will be Barrack Otieno and Grace Mutung'u. Each day, we will strive to get domain experts to help balance the debates and give them perspective. If there are any questions you would like answered during the online discussions or physical meeting, don't hesitate to reply to the list. Below are the sub-themes for the online discussions and a prologue of what to expect. Day One: 20th July 2015 Inclusiveness and Diversity: Is the ICT environment in Kenya inclusive—that is, with an atmosphere in which all people feel valued and respected and have access to the same opportunities? There have been several court cases in ICT/Internet space in the recent past where litigants lodged complaints about the processes used to constitute public bodies. A good part of the digital migration process also played out in the public galleries and in court. Looking at Kenya's past journey in ICT/Internet governance, has it been inclusive? Are we presently adhering to Article 10 on public participation in local Internet governance matters? Do the present mechanisms facilitate participation of all including those with disabilities? What is the state of Universal Access and implementation of Universal Service Fund in Kenya? Are the USF Council members representative of the Internet community in Kenya? Are all stakeholders' interests taken into consideration in forming the USF council? Day Three:22nd July 2015 Internet Economy: The rise of the Internet economy in Kenya has been defined by different strokes. On the one hand there are small entrepreneurs doing their side hustles from offices, small shops and car boots. They advertise their merchandise and services on social media and in a rudimentary form, some deliver merchandise in backpacks from door to door. Enter the bigger players who have large websites from where goods and services are purchased. Their business models differ. There are those such as OLX that provide a platform for users to interact. They make their money from adverting. Others such as Rupu and Jumia offer services and merchandise on reduced prices. Is there an adequate legal framework to protect consumers from fraud, deficient goods and services and to assure consumer rights in the Internet economy? Since the larger companies are doing well, is time ripe for the local Internet economy to be taxed to raise money for government services? Should other services in the Internet economy such as cloud services, international online purchases etc be taxed? Day Four:23rd July 2015 Critical Internet Resources: Is there an over arching national policy to guide infrastructure deployments within the country? What is the current state of fiber optic cables across the country? Is there any redundancy on the cables laid across the country? Are there policies in place for infrastructure sharing to avoid each operator laying their own cable thus passing the cost to the end user? What is the state of IXPs in Kenya? Where are we in keeping local traffic local as compared to say 2 years ago? Communications Authority requires all .ke registrars and the registry to be licensed by it before they commence business. Why is the registry being licensed? What would happen if CA withdrew the license for the registry? Why are registrars licensed twice, first by KENIC, then CA? Will over regulation hurt the industry? With the eminent depletion of IPv4 addressees around the world, what is the state of uptake of IPv6 addresses in Kenya? What is being done to ensure there is more uptake of IPv6? Then there is the exhaustion of IPv4 in some regions of the world like ARIN forcing them to go full V6 without dualstacking, what impact does that have to our country where most networks and content is on v4? Day Five :25th July 2015 Emerging Issues This topic attempts to provide the space to discuss a variety of emerging issues in the Internet space. For instance, the mandate of WSIS, a meeting of the UN that took place in 2005 in Tunis is coming to an end. WSIS process, started gave birth to the Internet Governance Forum (IGF) which is up for renewal end of this year. >From IGF discussions, there are no concrete proposals to form a permanent UN body for Internet governance. However, the discussions have borne many policies or “soft laws” that have guided relationships various stakeholders. Should the mandate of WSIS be extended for a further 10 years? Should the government of Kenya support a renewal of WSIS? Day Five and day 6 :25th-26th July 2015 Openness: "The idea of an open Internet is the idea that the full resources of the Internet and means to operate on it are easily accessible to all individuals and companies. This often includes ideas such as net neutrality, open standards, transparency, lack of Internet censorship, and low barriers to entry". We seek to answer questions like: how open is the Internet in Kenya? Is Freedom of Speech Online encouraged or it is suppressed? Are there examples of blocked websites in Kenya? How easy is it to start an Internet business in Kenya? Should Internet service provider (ISP) be allowed to speed up, slow down or block lawful Web traffic from getting to where you, the customer, want it to go? Should ISPs like Orange or Safaricom demand payment from content providers like Facebook or Google because these content providers reap huge profit from the infrastructure provided by ISPs? What is the position of the regulator on net neutrality? What is the position of service providers in Kenya on net neutrality? Once implemented, streaming services will also have to keep closer track of which subscribers fall under the new tax, whether through billing addresses or more restrictive methods like IP tracking, which is already used to enforce rights restrictions. Some lawyers have already taken issue with the city's move. After the rulings were announced, Reed Smith partner Michael Wynne argued the taxes violate both the Federal Telecommunications Act and, in the case of the second ruling, 1998's Internet Tax Freedom Act, intended to prevent discrimination against services delivered over the internet. "I could do that same activity of research using books or periodicals without being taxed," Wynne says. "So it does seem like I'm being picked on because I chose to do it online." But while the law may seem onerous, it's also a response to an increasingly difficult reality for cash-strapped cities, particularly as online services start to take a bite out of the businesses in the urban center. Twenty years ago, the same albums and movies were consumed at video rental outlets and music stores — which paid local property taxes, potentially paired with municipal sales taxes and other brick-and-mortar duties. But as online subscription services take over more and more of our music and video budgets, that money ends up disappearing from the traditional municipal tax base. By 2015, the people of Chicago are being entertained by corporations outside of the reach of the city government, leaving it scrambling to make up the difference. Facing a severe budget shortfall, it's easy to see how a city might look toward online services to fill the gap. Still, the net result for cloud services and customers alike is a confusing hodgepodge. If taxes like Chicago's become widespread, it could become a persistent problem for services like the newly launched Apple Music, which hope to tempt listeners away from ad-supported services like Spotify’s free tier. It would also mean further monitoring on where media is being consumed, which would mean the experience of using a VPN to watch a US-only video might be a harbinger of things to come. In the meantime, the law world is struggling to piece through what the old laws will really mean for the cloud. The DRAFT 2.0 is in attachment and can be commented on using this googledoc, this pad or via the mailing-list of the Dynamic Coalition on network Neutrality (DCNN). Comments converged as regards the need for a concise NN statement that may be compatible but independent from the Model Framework on Network Neutrality (MF), elaborated by the DCNN and presented at the 8th IGF. Michael and I consolidated the received comments into a quite concise Draft 2.0 and would like to have your advise on whether to include or not the specialised service provisions in this Draft. The possible options would be to: (i) Have a separate statement on specialised services. In this case a specialised service statement will be circulated in the forthcoming days for comments. (ii) Include concise specialised service provisions in the attached Draft 2.0. This option may provide a more complete text but may also make it more difficult to reach consensus on the Statement. (iii) Include detailed provisions on specialised service in an updated version of the MF. Such option would allow to have both a principle-statement, expressing a common IGF vision on NN, and a detailed MF 2.0 supported by DCNN members (and perhaps by GNN members?) providing specific indications on how to frame both NN and specialized services. The deadline to comment this second draft is Saturday 29 May. Subsequently a final draft will be shared and, if needed, an extra 10-day comment period will be opened. Best,Luca Dear all, (apologies for crossposting) This is a Request for Comments with regard to the development of two Policy Statements on Net Neutrality promoted by members of the IGF Dynamic Coalition on Network Neutrality (DCNN) and the Global Coalition on Net Neutrality (GNN), to be discussed within the IGF community at-large. SUBJECT The development of the DRAFT Net Neutrality Policy Statements aims at promoting the endorsement of an agreed position on net neutrality by the IGF community, based on the Model Framework on Network Neutrality developed by the DCNN. The development of these Policy Statements is consistent with the Final Chair's Summary of the IGF 2014, according to which "The ninth IGF concluded with looking at the role of the IGF in taking the network neutrality discussion forward. [...] The Dynamic Coalition on Network Neutrality will continue the discussions leading up to the 2015 meeting, but the view was also held that there was a need to develop a process that allowed the entire IGF community to weigh in and validate the findings of the Dynamic Coalition." The DCNN Model Framework (MF) was presented at the 8th IGF in Bali and included in a Report on "Protecting Human Rights through Network Neutrality" delivered to the Council of Europe Steering Committee on Media and Information Society to be used as a working document for the elaboration of a Draft Recommendation on Net Neutrality. To date, the MF has been conveyed to several Parliamentary assemblies (EU Parliament, Argentinian Senate and South Korean Parliament) by DCNN members. However, although it has already played an inspirational role, the model has never been officially validated by the IGF community at-large, as pointed out by the Chairs Summary. This lack of validation is primarily due to the lack of an official validation process for dynamic coalitions' outcomes within the IGF structure. The development of the Policy Statements aims therefore at filling this gap through a self-organised and bottom-up process, which is the very essence of the IGF. DRAFT POLICY STATEMENTS During the RightsCon joint meeting of the DCNN and the GNN, consensus emerged as regards the elaboration of one or more DRAFT Net Neutrality Policy Statement(s) to be presented to the IGF MAG and discussed - and hopefully endorsed - by the IGF community at-large. The initial DRAFT policy statements are in attachment. The first policy statement (I. On Network Neutrality) aims at providing a concise and "human readable" version of the MF, while the second statement (II. On Specialised Services) aims at expanding the MF definition and provisions on specialised services, adding some further elements. The statements also include a "restyling" of the MF (APPENDIX Model Framework v.2.0). The original provisions of the MF have been reorganised within this restyled version, in order to identify with more clarity the key issues that should be evoked in the policy statements. The only modification to the MF content concerns the expansion of the specialised service provisions, in order include the additional elements that are proposed in Statement II. DRAFTERS According to DC NN Rules of Procedure, two drafters have been designated in order to "manage the elaboration of the position or statement and consolidate received comments with the aim of achieving a consensus document." Listers, The Citizen Lab Summer Institute on Monitoring Internet Openness and Rights is a series of intensive research workshops hosted annually at the Munk School of Global Affairs, University of Toronto. The 2015 Citizen Lab Summer Institute (CLSI) will be held at the University of Toronto from June 24 to 26, 2015. The workshop will bring together participants from across a range of academic disciplines and practitioner communities.
