UPDATE ON KICTANET ENGAGEMENT WITH VARIOUS STAKEHOLDERS ON THE ICT PRACTITIONERS BILL

Dear all Further to our formal update on this matter on 17th August 2016. As we had earlier informed you, KICTANet is working in a consortium comprising of ourselves, the Kenya Private Sector Alliance (KEPSA), the Technology Service Providers of Kenya (TESPOK), Kenya Information Technology and Outsourcing Services (KITOS), Bloggers Association of Kenya (BAKE) and the iHub. The consortium after presenting a memorandum opposing the Bill was told that this was not among the options available to the National Assembly Energy and ICT Committee as the role of the committee was to consider the Bill and report back to the House. The Committee advised that we single out clauses that we would like amended and propose amendments. In considering amendments, the consortium was guided by the following: a) ICTs are novel and cross-cutting and therefore, many people in various professions may be defined as ICT practitioners if the term was to be broadly interpreted. The law should not target people whose primary occupation is not ICT or people who use ICT as an enabler to their primary occupation. b) There are many especially young people using ICTs to develop solutions to everyday challenges through experimental approaches. The law should not be crafted as a hindrance to innovation. c) After listening to the concerns of the sponsor of the Bill, where he cited quacks as a problem in the ICT sector, the consortium proposed that there could be a database of ICT practitioners but without accompanying encumbrances such as annual licensing, tests and mandatory training. d) Other issues were the need for a governing organ that was representative of the sector and the overarching principle that government/governance should be more of facilitative than a hindrance to people's freedom to achieve their destiny. We would just like to assure the network that we participated in proposing amendments as this was the only avenue provided by the Committee to receive our memorandum. We have always reiterated our position that we are opposed to this Bill in toto. We are awaiting the report of the Committee which will then be tabled in Parliament for subsequent parliamentary procedures. We are cognisant of the fact that the Bill is sponsored by the Member for Garissa Town who is also the Leader of Majority in the National Assembly. We had written to him expressing our opposition to the Bill and praying that Parliament help this sector by prioritising other crucial Bills such as the Data Protection Act. We call upon members of this network to join us in sensitizing Members of Parliament on our rationale for opposing this law. Kathy Brown's Internet Society ISOC President & CEO statements @IGF2016 underscore my remarks at the ICT 2016 Review; Our "middle-class syndrome" is at play here; the middle-class is giving a utopian view on the state of the Internet and ICT in general.Cables terminate where the low-income settlement starts, cut across the rural mainroads with no penetration into our villages. SGR is another opportunity for the rail line to cut through and yes, we shall sniff connectivity across towns. Yes, we may have a signal, however this is NOT equal to having access that is affordable to equitably harness the opportunities. i. The current model is propagating digitally-induced poverty; access, affordability and opportunity are not equitable ii. The Business thinking today will not solve the digital development challenge that it has created intentionally or not - it will only propagate it if left alone iii. The Technical Community must engage with the political system for the sake of the masses. The Technical Community and Academia must wear the "development cap" and political not just business orientation. iv. The Development Sector today focused on basic needs of water, healthcare, food must realise that in the knowledge economy, the next thing that will affect their people is segregation due to lack to knowing. CSOs must increasingly add to their programming Internet; access, affordability and opportunity. Again the Technical Community (and Academia) has a big role here as CSOs are not well versed on where to plug in into the technical debates and in turn development-based action plans. There must be a better formula to be better bedfellows with the Government (this is where policy is defined) building trust and legitimate roles for all players; even for small, illegit, unheard masses. Walu you are not off the hook! Academia, Development and Technical Community must have harmonious co-existence with Business and Government. ....perhaps that is how it is played from the political end. Finish what you started. Women online (and child safety) have formed key discussions in the overall Internet Governance discussions. “online abuse and gender based violence can, among other things, limit women’s ability to take advantage of the opportunities that ICTs provide for the full realisation of women's human rights, act as a barrier to access that can exacerbate the gender digital gap, often violate women’s human rights, and reaffirm and reproduce gender stereotypes”. Thus, countering online abuse and gender-based violence is essential for both inclusivity and sustainability. With the Kenyan elections 2017 around the corner, women aspirants online is one area where we experience the lifting of physical abuse into the online space with no recourse (or just brushed off). I recall Fadzai Madzingira of Facebook mentions that this is an area of FB focus. Fadzai may also kindly add to the discussion shedding light on what we expect to see (or is happening) specifically for "protection" of women aspirants online (and female voters) or safeguarding their online rights and equity or good practices elsewhere. Regards/Wangari Day 1 of 3: 2016 ICT Year in Review Feedback -Policy, Legal & Regulatory Issues Listers,(apologies for cross-posting) Thanksagain for those who spared time to provide feedback - so that the rest of uscan read and interrogate the same :-) Over thenext 3 days I shall share the feedback and basically hope to get furtherreactions from the floor. I attach the feedback document but withsummaries below: 1. Policy& Legal Feedback a) 52% of the respondents felt that the UniversalService Fund(USF) had not met its objective. 40% felt that it had to a moderateextent while 8% felt it had a very large extent. - CSOs tappinginto the fund; for advocacy, lobbying- Innovators - for groundbreaking research and solutions that others may ride on as enterprises a) 61% of therespondents felt that ICT Policies and initiative had not impacted thecounties. 23% of the respondents felt that these had moderately impacted thecounties, while 10% felt they had an impact to a very large extent.- CountyGovernments must take initiative to inbuilt in their services. c) 41% of the respondents felt that the multi-stakeholder approachbetween ICT stakeholders and government was moderately achieved. 31% feltit was not achieved while 25% felt it was, to a very large extent.We have seen public calls to ICT stakeholders by Government agencies- The Tech community contribution can do much better- CSOs are not at the forefront lobbying - perhaps may not have the capacity d) Policy/Legal Issues not yet addressed include: Cyber Crime /CyberSecurity Bill and its position in Senate and National Assembly, Data ProtectionBill, ICT Practitioners Bill, Privacy Issue Linkages between National &County Governments on ICT matters, Quality of Internet, Infrastructure SharingRegulatory FeedbackThe feedback loop can be improved2. Regulatory Feedbacka) 48% of the respondents felt that the question of affordable communications/internetpricing had not been well addressed. 30% felt that the question of affordablepricing has been moderately addressed while 20% felt it has been addressed to avery large extent.- CSOs who are best placed to lobbyfor this seem not to consider ICT as a frontier to venture into. They are stillfocused on the poverty areas where donors pump money of food, health, education- Donor support linked to the ICTs isnew frontier that entities like ISOC Chapter may champion forb) 68% of the respondents felt that the issue of dominance in the sectorwas affecting pricing of communication services to a very large extent. 16%felt it moderately affected pricing while 13% felt it was really not an issue.- Monopoly, oligopoly with a lukewarm regulator hand to players is notgood for the consumer. It is very good for the investor- The fact that the ICT sector is predominantly foreign-owned should be acontributor – with repatriation of profits and foreign versus local interestsc) 48% of the respondents felt that the urban-rural digital divide hadnot been adequately addressed while 34% felt that it had been moderatelyaddressed while only 7% felt it had been addressed to a very large extent. Urban-urban divide requires to get into the conversation. Today we share the feedback on the last thematic area :- InformationInfrastructure as given below. a) 86% of the respondents felt that governmentdigitization (Huduma Centers, eCitizen portal, etc) program has been useful toa very large extent. 12% felt it was moderately useful with a very smallminority1.5 thinking it has not been useful.The usefulness isundoubted when you look at access, possibly when you compare with a past whenit was not as efficient.Kenya has won awardsand honourable global recognition for some of the initiatives such as HudumaCenters.Let us move thediscourse forward now. Is this the best there is?- Could we define afuture then gauge from it- What other practicesare there in other countries- How is the businessand technical community riding on this “like over the top services”Areas to interrogate;- Local supply- Local labourWhat are the declared hiddencosts;- The user pays the feefor the service- There is anadministration fee e.g business name search went higher. What are the undeclaredhidden costs;- Buy a phone that iscompliant- The user absorbs theother hidden costs – internet bundles, cybercafé charge – cybers charge Ksh200-500 to assist with PIN registry plus cybercafé per minute charges- Centralised servicesaway from our local chiefs means transport costs - These undeclaredhidden costs are poverty propagators – the well to do seeking for efficiencymay not feel the pinch loudly, what of the hard-pressed?- Who is benefiting – Phonecompanies, ISPs, local cybersb) 48% of the respondents felt that thedigitization of government operations has gone to the other sectors to amoderate extent. 30% felt this cross-sector absorption of ICTs has not reallyhappened while 10% feel it has to a very large extent.A wholesome survey on the national state would aidto respond to this with affirmative- This is where CSOs plug in and conduct a neutralsurveyPR is important- Discussions in public recently were on how IFMISis said to propagate fraud by senior officials – Governors who definemwananchis mindset a lot. Leaders should be held accountable c) 52% of the respondents felt that the localcontent industry has NOT been well supported. 34% felt it has been moderatelysupported while only 8% felt it has been supported to a very large extent.We need a sharedappreciation of local content – and to broaden the scope- This has been takento be for TV, Radio mainly in the arts. - This would elicit heavy emotions versusrationalisation- Universities and higher level institutions can take this one d) 70% of the respondents felt that the issue ofinformation security has not been adequately addressed. 25% thought it had beenmoderately addressed while only 4% felt it had been addressed to a very largeextent.This must get into the Internet Governanceconversations- Lack of security or protection negates and reduces thethrust of ICTs driving the economyGod is merciful to us certainly because the day “saidfraudstar types” descend, Kenyans are in trouble- As a general public, awareness on security evenphysical security is not an every day factor- This makes digital security a farfetched subjectto most- Until money is involved- Data is conceptualPrivate sector as the provider of services must beincreasingly liable to protect its customers. Consumers trust that the produceris in the market and certified because they offer a good product – which includesprotection from all harm- Might this be a factor in increase in cost ofsome services - Consumer education should be reinforced. ByGovernment, CSOs and private sector – the way a product/service is broadcasted,the dangers should be highlighted tood) The following werementioned as key info-infrastructure interventions that have not beenaddressed/misaddressed: Misguided/aggressive e-Content regulation maybecounter-productive to local content industry. Security surveillance withoutData Protection Act is counter-productive. The Government Shared Serviceconcept still not effective, particularly at County levels. Expand eGovServices to be accessible thro USSD, Improve the user-interface on mostGovernment websites, enhance cyber security and offer public awareness programson the same. Today we to move to Day2a (HumanCapital feedback) and Day 2b (Infrastructure feedback to be sent in next email) Summary feedback on Human Capital wasas follows with detailed document attached. a) 41% of the respondents felt that the government hadprovided sufficient ICT opportunities for the youth to a moderate extent. 30%however felt youth opportunities had not been effectively provided, while 27%felt it had been done to a large extent. How far is this the mandate of the Government? - ICT Labour force projections; then building capacity backwards Some areas that may betapped into;- Private sector in capacity building of their staff- Personal initiatives to advance in ICT skills- Community resource centresb) 58% of therespondents felt that the DLP (Laptop Project) will have a positive impact to avery large extent. 30% felt it would be a moderate impact while 12% think itwill have little or no impact.
